Terms of Service

By accessing or using Lumen (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and the operator of Lumen.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We will indicate the date of the latest revision at the top of this page.

Lumen is a personal movie recommendation platform. It allows registered users to rate movies, maintain a watchlist, and receive personalised film recommendations based on their stated preferences. The Service is provided on an informational and entertainment basis only.

We make no representation that the recommendations provided are accurate, complete, current, or suitable for any particular purpose. Recommendations are generated algorithmically and reflect no endorsement of any film, studio, or distributor.

You must be at least 16 years of age to create an account and use the Service. By registering, you represent and warrant that you are 16 years of age or older. If you are under 18, you confirm that you have obtained the consent of a parent or legal guardian to use the Service.

To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at marcogagliardi84@gmail.com of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to protect your credentials.

You may not share your account with others or create accounts on behalf of third parties without explicit authorisation.

You agree not to use the Service to:

• violate any applicable local, national, or international law or regulation;
• attempt to gain unauthorised access to any part of the Service or its related systems;
• use automated scripts, bots, scrapers, or crawlers to access, collect, or copy any data from the Service;
• transmit any unsolicited or unauthorised advertising, promotional material, or spam;
• attempt to decompile, reverse-engineer, or disassemble any software forming part of the Service;
• interfere with or disrupt the integrity or performance of the Service or its infrastructure; or
• impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate accounts that violate these rules, without notice and without liability.

The Lumen name, logo, design, and all original software, text, and graphics are the property of the operator and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

Movie titles, descriptions, posters, and other metadata displayed within the Service are the property of their respective rights holders. Lumen claims no ownership over third-party content.

You retain ownership of any content you submit (such as personal ratings or reviews). By submitting such content, you grant us a non-exclusive, royalty-free, worldwide licence to use, store, and process that content solely for the purpose of operating and improving the Service.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that: (a) the Service will meet your requirements; (b) the Service will be available at any particular time or location; (c) any errors or defects will be corrected; (d) the Service is free of viruses or other harmful components; or (e) the results of using the Service, including any recommendations, will be accurate, reliable, or suitable for your needs.

Any reliance you place on content or recommendations provided by the Service is strictly at your own risk.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for any claims arising under or related to these Terms or the Service shall not exceed the greater of (a) the total amount you have paid us in the twelve months preceding the claim, or (b) €10 (ten euros). Because the Service is currently provided free of charge, this effectively means our liability is capped at €10.

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless the operator and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of or access to the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

We reserve the right to modify, suspend, or discontinue the Service, or any feature or part thereof, at any time and without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

We do not guarantee any particular level of service availability, uptime, or response time. The Service may experience downtime due to maintenance, outages, or events beyond our control.

We reserve the right to suspend or terminate your account and your access to the Service, at our sole discretion, for any reason, including breach of these Terms, with or without notice and without liability to you.

You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, 9, 12, and 13 shall survive termination.

These Terms are governed by and construed in accordance with the laws of Italy and the applicable regulations of the European Union, without regard to conflict-of-law principles. You agree that any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Italy, unless mandatory consumer protection laws in your country of residence provide otherwise.

We encourage you to contact us first at marcogagliardi84@gmail.com if you have any complaint or concern. We will make a good-faith effort to resolve disputes informally within 30 days.

If you are a consumer resident in the EU, you also have the right to use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings, whether written or oral, relating to the Service.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
